皮某訴某速運公司勞動爭議案:因用人單位原因中(zhong)斷勞動者(zhe)工作年(nian)限(xian)的(de)不影響(xiang)勞動者(zhe)工作年(nian)限(xian)的(de)連(lian)續計算(suan)
基本案情:2014年7月(yue)(yue)(yue)(yue)(yue),皮(pi)(pi)某(mou)(mou)(mou)與(yu)(yu)(yu)(yu)某(mou)(mou)(mou)速(su)(su)運(yun)公(gong)(gong)(gong)(gong)司(si)(si)(si)(si)張(zhang)(zhang)掖(ye)(ye)分(fen)公(gong)(gong)(gong)(gong)司(si)(si)(si)(si)簽(qian)訂(ding)(ding)(ding)勞動(dong)合(he)同,勞動(dong)合(he)同期限為(wei)(wei)2014年7月(yue)(yue)(yue)(yue)(yue)至2017年7月(yue)(yue)(yue)(yue)(yue)止。2017年8月(yue)(yue)(yue)(yue)(yue),皮(pi)(pi)某(mou)(mou)(mou)與(yu)(yu)(yu)(yu)某(mou)(mou)(mou)速(su)(su)運(yun)公(gong)(gong)(gong)(gong)司(si)(si)(si)(si)張(zhang)(zhang)掖(ye)(ye)分(fen)公(gong)(gong)(gong)(gong)司(si)(si)(si)(si)續(xu)簽(qian)勞動(dong)合(he)同,續(xu)簽(qian)勞動(dong)合(he)同期限為(wei)(wei)2017年8月(yue)(yue)(yue)(yue)(yue)起至2022年7月(yue)(yue)(yue)(yue)(yue)止。2018年4月(yue)(yue)(yue)(yue)(yue),皮(pi)(pi)某(mou)(mou)(mou)向某(mou)(mou)(mou)速(su)(su)運(yun)公(gong)(gong)(gong)(gong)司(si)(si)(si)(si)張(zhang)(zhang)掖(ye)(ye)分(fen)公(gong)(gong)(gong)(gong)司(si)(si)(si)(si)提(ti)交了員工辭職(zhi)申(shen)請(qing)(qing)表,該申(shen)請(qing)(qing)表載明離職(zhi)原因為(wei)(wei)個人原因。2018年5月(yue)(yue)(yue)(yue)(yue),皮(pi)(pi)某(mou)(mou)(mou)與(yu)(yu)(yu)(yu)某(mou)(mou)(mou)外包(bao)服務(wu)公(gong)(gong)(gong)(gong)司(si)(si)(si)(si)簽(qian)訂(ding)(ding)(ding)《勞動(dong)合(he)同書(shu)》,合(he)同簽(qian)訂(ding)(ding)(ding)后,皮(pi)(pi)某(mou)(mou)(mou)仍(reng)在張(zhang)(zhang)掖(ye)(ye)片(pian)區從事與(yu)(yu)(yu)(yu)其(qi)在某(mou)(mou)(mou)速(su)(su)運(yun)公(gong)(gong)(gong)(gong)司(si)(si)(si)(si)張(zhang)(zhang)掖(ye)(ye)分(fen)公(gong)(gong)(gong)(gong)司(si)(si)(si)(si)相(xiang)同的工作。期間,某(mou)(mou)(mou)速(su)(su)運(yun)公(gong)(gong)(gong)(gong)司(si)(si)(si)(si)張(zhang)(zhang)掖(ye)(ye)分(fen)公(gong)(gong)(gong)(gong)司(si)(si)(si)(si)向其(qi)發放榮譽證(zheng)書(shu),皮(pi)(pi)某(mou)(mou)(mou)仍(reng)通過某(mou)(mou)(mou)速(su)(su)運(yun)公(gong)(gong)(gong)(gong)司(si)(si)(si)(si)的考勤(qin)系(xi)統進(jin)行考勤(qin)。2022年4月(yue)(yue)(yue)(yue)(yue),皮(pi)(pi)某(mou)(mou)(mou)與(yu)(yu)(yu)(yu)某(mou)(mou)(mou)速(su)(su)運(yun)公(gong)(gong)(gong)(gong)司(si)(si)(si)(si)簽(qian)訂(ding)(ding)(ding)勞動(dong)合(he)同,勞動(dong)合(he)同期限為(wei)(wei)2022年4月(yue)(yue)(yue)(yue)(yue)起至2025年3月(yue)(yue)(yue)(yue)(yue)止。2023年5月(yue)(yue)(yue)(yue)(yue),某(mou)(mou)(mou)速(su)(su)運(yun)公(gong)(gong)(gong)(gong)司(si)(si)(si)(si)解除(chu)與(yu)(yu)(yu)(yu)皮(pi)(pi)某(mou)(mou)(mou)的勞動(dong)關系(xi)。皮(pi)(pi)某(mou)(mou)(mou)訴請(qing)(qing)確認某(mou)(mou)(mou)速(su)(su)運(yun)公(gong)(gong)(gong)(gong)司(si)(si)(si)(si)解除(chu)勞動(dong)合(he)同系(xi)違法解除(chu),要(yao)求支付違法解除(chu)勞動(dong)合(he)同賠償金。
裁判結果:法(fa)院判決某速運公司給付皮某違(wei)法(fa)解除(chu)勞動(dong)合同經濟(ji)賠償金163971.9元。
典型(xing)意義:新就業形(xing)態下,物(wu)流(liu)(liu)公司(si)(si)將(jiang)(jiang)其一線(xian)從(cong)(cong)業人(ren)員(yuan)外(wai)包(bao)并要求從(cong)(cong)業人(ren)員(yuan)與其他(ta)公司(si)(si)簽(qian)訂(ding)(ding)用(yong)工(gong)合(he)同(tong)的現象普遍存在,若從(cong)(cong)業人(ren)員(yuan)工(gong)作(zuo)(zuo)到一定年限,又須按照(zhao)規定重新與物(wu)流(liu)(liu)公司(si)(si)的上(shang)級公司(si)(si)簽(qian)訂(ding)(ding)相應的勞(lao)(lao)動(dong)合(he)同(tong)。因此,勞(lao)(lao)動(dong)者(zhe)(zhe)在物(wu)流(liu)(liu)公司(si)(si)工(gong)作(zuo)(zuo)年限的認定就成為處理該(gai)類勞(lao)(lao)動(dong)爭議的關鍵(jian)。本案中(zhong),物(wu)流(liu)(liu)公司(si)(si)將(jiang)(jiang)從(cong)(cong)業人(ren)員(yuan)外(wai)包(bao)并分(fen)別簽(qian)訂(ding)(ding)勞(lao)(lao)動(dong)合(he)同(tong),對于從(cong)(cong)業人(ren)員(yuan)有證據證明物(wu)流(liu)(liu)公司(si)(si)存在將(jiang)(jiang)勞(lao)(lao)動(dong)者(zhe)(zhe)不(bu)正當(dang)外(wai)包(bao)導致從(cong)(cong)業人(ren)員(yuan)工(gong)作(zuo)(zuo)年限不(bu)連續(xu)(xu)的情形(xing)下,法院(yuan)應認定勞(lao)(lao)動(dong)者(zhe)(zhe)與用(yong)人(ren)單位的勞(lao)(lao)動(dong)關系存續(xu)(xu)期間連續(xu)(xu)計(ji)算,為新業態從(cong)(cong)業人(ren)員(yuan)筑(zhu)牢權益保(bao)障(zhang)底(di)線(xian)。
黃某訴某醫院勞動爭議案:勞(lao)(lao)動者(zhe)主(zhu)張未簽訂勞(lao)(lao)動合(he)同雙倍工資等賠償時,勞(lao)(lao)動者(zhe)實(shi)際工資明(ming)顯高于(yu)本地行(xing)業(ye)從業(ye)人員(yuan)月平均工資三倍的應予以調(diao)整
基本案情:2019年6月,黃(huang)(huang)某(mou)(mou)入職(zhi)(zhi)某(mou)(mou)醫院(yuan)工(gong)(gong)作,雙方未簽訂(ding)書面勞(lao)動合同,某(mou)(mou)醫院(yuan)未給黃(huang)(huang)某(mou)(mou)參(can)加和(he)繳納社(she)會保險。2020年9月,黃(huang)(huang)某(mou)(mou)以未能及時足額支付工(gong)(gong)資(zi)(zi)為由向某(mou)(mou)醫院(yuan)法定代表人(ren)遞交離職(zhi)(zhi)告(gao)知書并離職(zhi)(zhi)。離職(zhi)(zhi)后,黃(huang)(huang)某(mou)(mou)訴(su)請某(mou)(mou)醫院(yuan)支付解除勞(lao)動合同經濟補償金82500元(yuan)、未簽訂(ding)書面勞(lao)動合同雙倍工(gong)(gong)資(zi)(zi)650000元(yuan)、支付2020年8月工(gong)(gong)資(zi)(zi)40500元(yuan)。
裁判結果:法院(yuan)(yuan)經(jing)審理判決:一(yi)、某(mou)醫院(yuan)(yuan)與黃某(mou)勞(lao)動(dong)合同(tong)于2020年9月2日解除(chu);二、某(mou)醫院(yuan)(yuan)向黃某(mou)支付拖欠的工資40500元、解除(chu)勞(lao)動(dong)合同(tong)經(jing)濟補償金(jin)29335.14元、未簽訂書面勞(lao)動(dong)合同(tong)的雙倍(bei)工資215124.36元。
典型意義:《中華人民共和(he)國勞(lao)動(dong)(dong)(dong)(dong)合同(tong)法(fa)(fa)》等相關法(fa)(fa)律(lv)、司(si)法(fa)(fa)解釋(shi)均未明確(que)規定未簽(qian)(qian)(qian)訂勞(lao)動(dong)(dong)(dong)(dong)合同(tong)雙(shuang)(shuang)倍(bei)(bei)(bei)工資(zi)(zi)差額(e)(e)的(de)(de)計算(suan)標(biao)準(zhun),故應從(cong)法(fa)(fa)律(lv)及相關司(si)法(fa)(fa)解釋(shi)設立未簽(qian)(qian)(qian)訂勞(lao)動(dong)(dong)(dong)(dong)合同(tong)雙(shuang)(shuang)倍(bei)(bei)(bei)工資(zi)(zi)差額(e)(e)的(de)(de)立法(fa)(fa)目的(de)(de)以及影響勞(lao)動(dong)(dong)(dong)(dong)者實(shi)體(ti)權利等方面綜合考(kao)量(liang)。本案中,法(fa)(fa)院(yuan)(yuan)認定黃某(mou)自2019年7月至2020年5月期(qi)間月平(ping)均工資(zi)(zi)為53003.64元,明顯高于(yu)所(suo)在(zai)市(shi)人民政府公布(bu)的(de)(de)本地區(qu)2019年度衛生和(he)社(she)會(hui)工作(zuo)行(xing)業從(cong)業人員月平(ping)均工資(zi)(zi)6518.92元的(de)(de)三(san)倍(bei)(bei)(bei)即19556.76元。法(fa)(fa)院(yuan)(yuan)結(jie)合本案實(shi)際情況及本地行(xing)業從(cong)業人員工資(zi)(zi)標(biao)準(zhun),認定黃某(mou)主張的(de)(de)未簽(qian)(qian)(qian)訂書面勞(lao)動(dong)(dong)(dong)(dong)合同(tong)雙(shuang)(shuang)倍(bei)(bei)(bei)工資(zi)(zi)差額(e)(e)以所(suo)在(zai)市(shi)人民政府公布(bu)的(de)(de)本地區(qu)2019年度衛生和(he)社(she)會(hui)工作(zuo)行(xing)業從(cong)業人員月平(ping)均工資(zi)(zi)6518.92元的(de)(de)三(san)倍(bei)(bei)(bei)計算(suan),既(ji)對用人單位未與勞(lao)動(dong)(dong)(dong)(dong)者簽(qian)(qian)(qian)訂書面勞(lao)動(dong)(dong)(dong)(dong)合同(tong)進行(xing)懲(cheng)戒,又避免用人單位因承(cheng)受過(guo)重的(de)(de)懲(cheng)罰性金額(e)(e)導致企業運營困難(nan),符合法(fa)(fa)律(lv)關于(yu)未簽(qian)(qian)(qian)訂勞(lao)動(dong)(dong)(dong)(dong)合同(tong)雙(shuang)(shuang)倍(bei)(bei)(bei)工資(zi)(zi)差額(e)(e)的(de)(de)立法(fa)(fa)目的(de)(de)。
某(mou)科(ke)技公司訴樊某(mou)競業限制糾紛案:競業限制違約金與(yu)經(jing)濟補償明顯不對(dui)等的應予調整
基本案情:樊(fan)某于2022年9月入職(zhi)某科技公(gong)司,工資標準(zhun)為(wei)15000元(yuan)(yuan)+績效(不固定(ding)(ding))。2023年8月,雙(shuang)方(fang)(fang)簽訂《勞務合(he)同》及(ji)《競業(ye)(ye)禁(jin)(jin)止協議》。《競業(ye)(ye)禁(jin)(jin)止協議》載明:競業(ye)(ye)區(qu)域(yu)包含某市行(xing)政管轄的(de)縣區(qu),以(yi)及(ji)甲方(fang)(fang)的(de)分支(zhi)機構和與甲方(fang)(fang)有關(guan)聯合(he)作的(de)分支(zhi)機構所轄市級管轄行(xing)政區(qu)域(yu)。如樊(fan)某離職(zhi)后,未(wei)履行(xing)雙(shuang)方(fang)(fang)約定(ding)(ding)的(de)競業(ye)(ye)限(xian)制義務的(de),除應立(li)即改(gai)正(zheng)外(wai),還應向(xiang)某科技公(gong)司支(zhi)付違(wei)約金(jin)(jin),違(wei)約金(jin)(jin)的(de)標準(zhun)為(wei):雙(shuang)方(fang)(fang)約定(ding)(ding)的(de)競業(ye)(ye)限(xian)制補償金(jin)(jin)月標準(zhun)×雙(shuang)方(fang)(fang)約定(ding)(ding)的(de)離職(zhi)后競業(ye)(ye)限(xian)制期間(jian)的(de)月份(fen)數×十倍。2024年2月樊(fan)某離職(zhi)。樊(fan)某離職(zhi)后,從事競業(ye)(ye)行(xing)為(wei)。故(gu)某科技公(gong)司訴至(zhi)法院,請求樊(fan)某支(zhi)付違(wei)反競業(ye)(ye)禁(jin)(jin)止協議違(wei)約金(jin)(jin)120000元(yuan)(yuan)。
裁判結果:法院(yuan)經審理(li)作(zuo)出判決(jue):一(yi)、樊某于本判決(jue)生效后十(shi)日內向(xiang)某科技公司支付違(wei)約金50000元;二、駁回某科技公司的其(qi)他訴訟請求。
典型意(yi)義:競(jing)(jing)業(ye)(ye)限制(zhi)制(zhi)度(du)主要目的(de)(de)(de)(de)在于(yu)保護用(yong)人(ren)單(dan)位的(de)(de)(de)(de)商業(ye)(ye)秘(mi)密(mi),規(gui)制(zhi)不當競(jing)(jing)爭行為(wei)。實踐中,部分用(yong)人(ren)單(dan)位可能存(cun)在利用(yong)其優勢地位,忽(hu)視訂(ding)立協議過(guo)程應(ying)遵循協商一致(zhi)的(de)(de)(de)(de)原(yuan)則(ze),與(yu)勞(lao)動者(zhe)(zhe)約(yue)(yue)(yue)定(ding)競(jing)(jing)業(ye)(ye)限制(zhi)違(wei)(wei)約(yue)(yue)(yue)金(jin)時存(cun)在違(wei)(wei)約(yue)(yue)(yue)金(jin)與(yu)補償(chang)金(jin)明顯不對(dui)等(deng)的(de)(de)(de)(de)情形。勞(lao)動者(zhe)(zhe)申請對(dui)約(yue)(yue)(yue)定(ding)過(guo)高的(de)(de)(de)(de)違(wei)(wei)約(yue)(yue)(yue)金(jin)進行調整(zheng)的(de)(de)(de)(de),人(ren)民法(fa)院應(ying)基(ji)于(yu)公(gong)平(ping)原(yuan)則(ze),充(chong)分發揮司(si)法(fa)裁判的(de)(de)(de)(de)指(zhi)引功(gong)能,在綜合考慮勞(lao)動者(zhe)(zhe)掌握的(de)(de)(de)(de)商業(ye)(ye)秘(mi)密(mi)價值、工(gong)作時間、工(gong)作崗(gang)位、工(gong)資(zi)水平(ping)、主觀(guan)違(wei)(wei)約(yue)(yue)(yue)惡意(yi)、客(ke)觀(guan)違(wei)(wei)約(yue)(yue)(yue)情節、競(jing)(jing)業(ye)(ye)限制(zhi)補償(chang)金(jin)數額及(ji)違(wei)(wei)約(yue)(yue)(yue)行為(wei)給用(yong)人(ren)單(dan)位造(zao)成實際損失(shi)等(deng)因(yin)素的(de)(de)(de)(de)基(ji)礎(chu)上予以調整(zheng),實現勞(lao)動者(zhe)(zhe)權益和(he)用(yong)人(ren)單(dan)位商業(ye)(ye)秘(mi)密(mi)的(de)(de)(de)(de)雙(shuang)重保護。
某商貿公司與吳某勞動爭議案:超過法定退休年齡(ling)勞動者(zhe)因(yin)用人單位(wei)未享受(shou)養老(lao)保險(xian)待遇繼(ji)續(xu)在用人單位(wei)工作(zuo)的應認定勞動關系
基本案情:吳(wu)某(mou)(mou)(mou)入職(zhi)某(mou)(mou)(mou)商(shang)(shang)貿公司(si)(si)擔任導購員,雙方于(yu)2013年(nian)3月(yue)簽訂(ding)書面(mian)勞(lao)(lao)動(dong)合(he)(he)同,約(yue)定吳(wu)某(mou)(mou)(mou)工(gong)作崗位(wei)由(you)導購轉為(wei)業(ye)務。2020年(nian)8月(yue),吳(wu)某(mou)(mou)(mou)達到法(fa)定退休年(nian)齡(ling)后(hou)仍繼續在某(mou)(mou)(mou)商(shang)(shang)貿公司(si)(si)工(gong)作。2023年(nian)6月(yue),因某(mou)(mou)(mou)商(shang)(shang)貿公司(si)(si)欠付工(gong)資,吳(wu)某(mou)(mou)(mou)在業(ye)務員離(li)(li)(退)職(zhi)申請表(biao)簽字后(hou)離(li)(li)職(zhi)。某(mou)(mou)(mou)商(shang)(shang)貿公司(si)(si)未為(wei)吳(wu)某(mou)(mou)(mou)繳納社會保險。吳(wu)某(mou)(mou)(mou)訴請確認與(yu)某(mou)(mou)(mou)商(shang)(shang)貿公司(si)(si)之間的勞(lao)(lao)動(dong)關(guan)系,要求(qiu)該公司(si)(si)支(zhi)付未簽訂(ding)無固(gu)定期限勞(lao)(lao)動(dong)合(he)(he)同二倍工(gong)資、解除勞(lao)(lao)動(dong)合(he)(he)同的經(jing)濟賠(pei)償金。
裁判(pan)結果:法院經審(shen)理作出判(pan)決(jue):一(yi)、吳(wu)某與某商(shang)貿(mao)公司(si)于2007年1月1日至2023年6月11日期間存(cun)在勞動關系(xi);二(er)、某商(shang)貿(mao)公司(si)于判(pan)決(jue)生效之日起(qi)十五日內向(xiang)吳(wu)某支付(fu)經濟補償金(jin)71400元;三、駁回吳(wu)某其他(ta)訴訟請求。

張某訴某縣屬企業生(sheng)活費糾(jiu)紛案(an):主張停薪留職期(qi)滿(man)后的生活費不適用舉(ju)證責任倒置

典(dian)型意義(yi)(yi):根據《中(zhong)華人(ren)(ren)民共和(he)國勞(lao)(lao)動(dong)(dong)爭議調(diao)解仲裁法(fa)》《工(gong)(gong)資(zi)(zi)支(zhi)付(fu)暫(zan)行規定》的(de)相關規定,在處理拖欠工(gong)(gong)資(zi)(zi)等特殊案件時(shi),舉證(zheng)責任(ren)可(ke)以(yi)倒置。但本(ben)案的(de)核心爭議系停薪留(liu)(liu)職(zhi)期(qi)滿后是否發(fa)放(fang)(fang)生(sheng)活費(fei),不能(neng)簡單(dan)(dan)(dan)適用工(gong)(gong)資(zi)(zi)舉證(zheng)責任(ren)倒置規則(ze)。“工(gong)(gong)資(zi)(zi)發(fa)放(fang)(fang)舉證(zheng)責任(ren)倒置”的(de)適用前提是勞(lao)(lao)動(dong)(dong)關系成立且勞(lao)(lao)動(dong)(dong)者提供實(shi)(shi)際勞(lao)(lao)動(dong)(dong)。首先(xian),本(ben)案中(zhong),申請人(ren)(ren)沒(mei)(mei)有提供實(shi)(shi)際勞(lao)(lao)動(dong)(dong),被申請人(ren)(ren)就(jiu)沒(mei)(mei)有支(zhi)付(fu)勞(lao)(lao)動(dong)(dong)報酬(chou)的(de)義(yi)(yi)務,更沒(mei)(mei)有舉證(zheng)工(gong)(gong)資(zi)(zi)發(fa)放(fang)(fang)的(de)義(yi)(yi)務。其(qi)次(ci),《工(gong)(gong)資(zi)(zi)支(zhi)付(fu)暫(zan)行規定》明確,“非因勞(lao)(lao)動(dong)(dong)者原因造(zao)成單(dan)(dan)(dan)位停工(gong)(gong)、停產”,用人(ren)(ren)單(dan)(dan)(dan)位需要按照國家規定支(zhi)付(fu)生(sheng)活費(fei)。此(ci)處,勞(lao)(lao)動(dong)(dong)者應(ying)當就(jiu)“非勞(lao)(lao)動(dong)(dong)者原因停工(gong)(gong)停產”承擔舉證(zheng)責任(ren),用人(ren)(ren)單(dan)(dan)(dan)位應(ying)當就(jiu)“不及時(shi)發(fa)放(fang)(fang)勞(lao)(lao)動(dong)(dong)報酬(chou)或生(sheng)活費(fei)”承擔舉證(zheng)責任(ren)。本(ben)案中(zhong),仲裁委查(cha)明張某沒(mei)(mei)有向企業申請上(shang)崗,更沒(mei)(mei)有提供實(shi)(shi)際勞(lao)(lao)動(dong)(dong),在此(ci)期(qi)間(jian)自(zi)行經營實(shi)(shi)體(ti)生(sheng)意,沒(mei)(mei)有返崗工(gong)(gong)作的(de)跡象,不能(neng)證(zheng)明其(qi)屬于(yu)(yu)非本(ben)人(ren)(ren)原因停工(gong)(gong)待崗。因此(ci),張某提出仲裁申請要求用人(ren)(ren)單(dan)(dan)(dan)位支(zhi)付(fu)停薪留(liu)(liu)職(zhi)期(qi)滿后的(de)工(gong)(gong)資(zi)(zi)于(yu)(yu)法(fa)無據,仲裁委對此(ci)不予支(zhi)持。
在企業(ye)(ye)(ye)改制進程(cheng)中,鼓勵(li)勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)者(zhe)(zhe)(zhe)自主創業(ye)(ye)(ye)以減(jian)輕企業(ye)(ye)(ye)負(fu)擔的(de)情況較(jiao)為常(chang)見。然而創業(ye)(ye)(ye)期滿后,因勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)者(zhe)(zhe)(zhe)未按期返(fan)崗或企業(ye)(ye)(ye)未及時通知勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)者(zhe)(zhe)(zhe)上崗引發的(de)爭議較(jiao)多。尤其當勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)者(zhe)(zhe)(zhe)年齡漸長,企業(ye)(ye)(ye)拒絕(jue)其返(fan)崗訴求時,雙方常(chang)因未規范解除勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)關系(xi)程(cheng)序,陷入“名義存續、事實(shi)(shi)中止”的(de)僵局。仲裁(cai)委和法院雖依據《中華人民共(gong)和國勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)合同法》認定勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)關系(xi)存續,但實(shi)(shi)際雙方已(yi)無用工實(shi)(shi)質(zhi),權利義務處(chu)于中止狀態(tai),勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)者(zhe)(zhe)(zhe)主張(zhang)此(ci)階(jie)段權利通常(chang)難以得到支持。
本案啟(qi)示(shi)用(yong)人(ren)單(dan)位與(yu)勞(lao)動者協商(shang)停薪留職時(shi),務必簽(qian)訂書面協議,明(ming)確創業時(shi)間、雙方(fang)權利義務、違(wei)約(yue)責任及期滿后(hou)相關事項等內容。企業若(ruo)不(bu)愿繼續(xu)雇用(yong)勞(lao)動者或勞(lao)動者違(wei)反約(yue)定的,應及時(shi)出具(ju)并送達相關通知,規(gui)范解除流程(cheng),避免勞(lao)動爭議發生。
