對公職人員成為監察對象前的違法行為如何處置

  【典型案例】

  李(li)某,某全額撥款事(shi)業單(dan)(dan)位(wei)下屬(shu)A公(gong)(gong)司(si)的(de)出納,2013年(nian)開始在A公(gong)(gong)司(si)工作(zuo),2013年(nian)2月將一(yi)筆金額40萬元的(de)A公(gong)(gong)司(si)資金用(yong)于個(ge)(ge)人理(li)財,一(yi)個(ge)(ge)月后歸還,按照(zhao)刑(xing)法的(de)規定已超過(guo)追(zhui)訴時效(xiao)。初核發(fa)現,A公(gong)(gong)司(si)直到(dao)2015年(nian)才(cai)改制為該(gai)事(shi)業單(dan)(dan)位(wei)獨資公(gong)(gong)司(si),改制前(qian)屬(shu)國有控股公(gong)(gong)司(si),而李(li)某是(shi)A公(gong)(gong)司(si)經該(gai)事(shi)業單(dan)(dan)位(wei)授權直接招聘的(de)合同(tong)制人員,該(gai)事(shi)業單(dan)(dan)位(wei)按照(zhao)雇員制管理(li)辦法對其進行管理(li)。

  【分歧意見】

  本案中,對(dui)李某現在屬于監(jian)察對(dui)象這一點沒有異議;但李某的挪用行為(wei)發生(sheng)在A公司改制前,對(dui)其成為(wei)監(jian)察對(dui)象前實施的違法行為(wei)如何處置存(cun)在爭議,主要(yao)有三(san)種意(yi)見:

  第(di)一(yi)種意(yi)見認為(wei)(wei):李(li)(li)(li)某(mou)實施挪用行為(wei)(wei)時(shi)A公司并(bing)(bing)不是(shi)國有獨資公司,且李(li)(li)(li)某(mou)是(shi)A公司自主招聘的(de)工(gong)作人(ren)(ren)員,按照(zhao)A公司授權(quan)(quan)開展出納工(gong)作,并(bing)(bing)非(fei)行使(shi)公權(quan)(quan)力(li),因(yin)此李(li)(li)(li)某(mou)既不屬(shu)于(yu)國家工(gong)作人(ren)(ren)員,也不屬(shu)于(yu)公職(zhi)人(ren)(ren)員。李(li)(li)(li)某(mou)的(de)行為(wei)(wei)構成(cheng)刑法第(di)二(er)百七(qi)十(shi)二(er)條第(di)一(yi)款(kuan)(kuan)的(de)挪用資金(jin),不構成(cheng)職(zhi)務違法,屬(shu)其他違法行為(wei)(wei)。但李(li)(li)(li)某(mou)現在是(shi)監(jian)察對(dui)(dui)象,按照(zhao)監(jian)察法實施條例(li)第(di)二(er)十(shi)四條第(di)二(er)款(kuan)(kuan)的(de)規定,“監(jian)察機關發現公職(zhi)人(ren)(ren)員成(cheng)為(wei)(wei)監(jian)察對(dui)(dui)象前有前款(kuan)(kuan)規定的(de)違法行為(wei)(wei)的(de),依照(zhao)前款(kuan)(kuan)規定辦(ban)理”,即監(jian)察機關可以直接對(dui)(dui)李(li)(li)(li)某(mou)的(de)挪用資金(jin)行為(wei)(wei)給予政務處分(fen)。

  第(di)二(er)種(zhong)意(yi)見認為(wei):同意(yi)李(li)某(mou)不屬于國家工(gong)(gong)作人員(yuan)的(de)意(yi)見。但A公司(si)改制前,李(li)某(mou)作為(wei)國有(you)控股公司(si)的(de)出納(na),從(cong)事(shi)(shi)的(de)工(gong)(gong)作包括(kuo)對屬于國有(you)的(de)部(bu)分財產(chan)的(de)監(jian)督、管理活動,參照《全國法(fa)院審理經濟犯罪案(an)件工(gong)(gong)作座(zuo)談會(hui)紀要(yao)》屬于從(cong)事(shi)(shi)公務,應(ying)當認定為(wei)公職(zhi)人員(yuan)。李(li)某(mou)的(de)行為(wei)構成刑法(fa)第(di)二(er)百七十二(er)條(tiao)第(di)一款規(gui)定的(de)挪用資金行為(wei),且(qie)系職(zhi)務違法(fa),監(jian)察機關應(ying)當據此給(gei)予其(qi)政務處分。

  第三種意(yi)見認為:A公(gong)(gong)司招聘李(li)某(mou)是經過(guo)某(mou)事(shi)業(ye)單(dan)位(wei)授權(quan),且由該事(shi)業(ye)單(dan)位(wei)按照雇(gu)員(yuan)制管(guan)(guan)理辦法管(guan)(guan)理,屬于國有(you)事(shi)業(ye)單(dan)位(wei)委派到國有(you)控股公(gong)(gong)司從事(shi)公(gong)(gong)務的人(ren)員(yuan),應當以國家工作人(ren)員(yuan)論(lun)。李(li)某(mou)的行為構成刑(xing)法第二百七十二條第二款規定的挪(nuo)用公(gong)(gong)款行為,監察機關應當據此給予其政務處分(fen)。

  【評析意見】

  筆者(zhe)贊同(tong)第三種意見(jian),理(li)由如下。

  一、如(ru)果(guo)依(yi)第一種意見認(ren)為李(li)某挪用A公(gong)司資金時不(bu)是(shi)公(gong)職人(ren)員,則(ze)不(bu)能依(yi)據相關規定給(gei)予其政(zheng)務處分

  根據監(jian)察(cha)法(fa)(fa)及其實施條例相(xiang)關(guan)(guan)規定(ding),公(gong)(gong)職(zhi)人(ren)(ren)員(yuan)成(cheng)為(wei)(wei)(wei)(wei)監(jian)察(cha)對(dui)(dui)(dui)象前的(de)(de)違(wei)(wei)法(fa)(fa)行(xing)為(wei)(wei)(wei)(wei)可(ke)以(yi)分(fen)為(wei)(wei)(wei)(wei)職(zhi)務違(wei)(wei)法(fa)(fa)行(xing)為(wei)(wei)(wei)(wei)和其他違(wei)(wei)法(fa)(fa)行(xing)為(wei)(wei)(wei)(wei)。因為(wei)(wei)(wei)(wei)政務處(chu)(chu)分(fen)法(fa)(fa)無(wu)時效(xiao)規定(ding),監(jian)察(cha)機(ji)關(guan)(guan)有權(quan)對(dui)(dui)(dui)公(gong)(gong)職(zhi)人(ren)(ren)員(yuan)成(cheng)為(wei)(wei)(wei)(wei)監(jian)察(cha)對(dui)(dui)(dui)象前的(de)(de)職(zhi)務違(wei)(wei)法(fa)(fa)行(xing)為(wei)(wei)(wei)(wei)給(gei)予政務處(chu)(chu)分(fen)無(wu)需贅(zhui)述。監(jian)察(cha)法(fa)(fa)實施條例第(di)二(er)十四條規定(ding)了(le)(le)對(dui)(dui)(dui)公(gong)(gong)職(zhi)人(ren)(ren)員(yuan)其他違(wei)(wei)法(fa)(fa)行(xing)為(wei)(wei)(wei)(wei)的(de)(de)調(diao)查(cha)處(chu)(chu)置,其中(zhong)第(di)一款強調(diao)即(ji)便(bian)違(wei)(wei)法(fa)(fa)行(xing)為(wei)(wei)(wei)(wei)與職(zhi)務無(wu)關(guan)(guan),但關(guan)(guan)乎公(gong)(gong)職(zhi)人(ren)(ren)員(yuan)的(de)(de)道德操守,監(jian)察(cha)機(ji)關(guan)(guan)仍有權(quan)調(diao)查(cha)、處(chu)(chu)置,體(ti)現(xian)了(le)(le)對(dui)(dui)(dui)公(gong)(gong)職(zhi)人(ren)(ren)員(yuan)監(jian)察(cha)事項橫向(xiang)的(de)(de)全(quan)覆(fu)蓋;第(di)二(er)款強調(diao)對(dui)(dui)(dui)公(gong)(gong)職(zhi)人(ren)(ren)員(yuan)成(cheng)為(wei)(wei)(wei)(wei)監(jian)察(cha)對(dui)(dui)(dui)象前的(de)(de)其他違(wei)(wei)法(fa)(fa)行(xing)為(wei)(wei)(wei)(wei)也(ye)可(ke)調(diao)查(cha)、處(chu)(chu)置,體(ti)現(xian)了(le)(le)對(dui)(dui)(dui)公(gong)(gong)職(zhi)人(ren)(ren)員(yuan)監(jian)察(cha)事項縱向(xiang)的(de)(de)全(quan)覆(fu)蓋。

  在理解(jie)第二款(kuan)時(shi),需注意,這(zhe)里的(de)“公(gong)(gong)職(zhi)人(ren)(ren)(ren)(ren)(ren)員(yuan)(yuan)(yuan)(yuan)”是(shi)僅指(zhi)成(cheng)為(wei)(wei)(wei)(wei)監(jian)(jian)察(cha)(cha)(cha)對象(xiang)(xiang)前(qian)后都是(shi)公(gong)(gong)職(zhi)人(ren)(ren)(ren)(ren)(ren)員(yuan)(yuan)(yuan)(yuan)的(de)情(qing)形,還是(shi)指(zhi)包括成(cheng)為(wei)(wei)(wei)(wei)監(jian)(jian)察(cha)(cha)(cha)對象(xiang)(xiang)前(qian)不是(shi)公(gong)(gong)職(zhi)人(ren)(ren)(ren)(ren)(ren)員(yuan)(yuan)(yuan)(yuan),成(cheng)為(wei)(wei)(wei)(wei)監(jian)(jian)察(cha)(cha)(cha)對象(xiang)(xiang)后才成(cheng)為(wei)(wei)(wei)(wei)公(gong)(gong)職(zhi)人(ren)(ren)(ren)(ren)(ren)員(yuan)(yuan)(yuan)(yuan)的(de)情(qing)形?第一種情(qing)形是(shi)監(jian)(jian)察(cha)(cha)(cha)法的(de)實(shi)施使(shi)(shi)某人(ren)(ren)(ren)(ren)(ren)成(cheng)為(wei)(wei)(wei)(wei)監(jian)(jian)察(cha)(cha)(cha)對象(xiang)(xiang),比如高校的(de)管(guan)理人(ren)(ren)(ren)(ren)(ren)員(yuan)(yuan)(yuan)(yuan)、國企的(de)管(guan)理人(ren)(ren)(ren)(ren)(ren)員(yuan)(yuan)(yuan)(yuan)等,改(gai)革(ge)后的(de)監(jian)(jian)察(cha)(cha)(cha)體制實(shi)現對所(suo)有行使(shi)(shi)公(gong)(gong)權力的(de)人(ren)(ren)(ren)(ren)(ren)員(yuan)(yuan)(yuan)(yuan)全覆蓋,這(zhe)類人(ren)(ren)(ren)(ren)(ren)員(yuan)(yuan)(yuan)(yuan)便成(cheng)為(wei)(wei)(wei)(wei)了監(jian)(jian)察(cha)(cha)(cha)對象(xiang)(xiang)。第二種情(qing)形是(shi)相(xiang)關事實(shi)行為(wei)(wei)(wei)(wei)使(shi)(shi)某人(ren)(ren)(ren)(ren)(ren)成(cheng)為(wei)(wei)(wei)(wei)監(jian)(jian)察(cha)(cha)(cha)對象(xiang)(xiang),比如大(da)學畢(bi)業(ye)生(sheng)后通過公(gong)(gong)開招錄(lu)成(cheng)為(wei)(wei)(wei)(wei)公(gong)(gong)務(wu)員(yuan)(yuan)(yuan)(yuan),這(zhe)類人(ren)(ren)(ren)(ren)(ren)員(yuan)(yuan)(yuan)(yuan)成(cheng)為(wei)(wei)(wei)(wei)監(jian)(jian)察(cha)(cha)(cha)對象(xiang)(xiang)前(qian)后身份發生(sheng)了變化,從(cong)非公(gong)(gong)職(zhi)人(ren)(ren)(ren)(ren)(ren)員(yuan)(yuan)(yuan)(yuan)成(cheng)為(wei)(wei)(wei)(wei)公(gong)(gong)職(zhi)人(ren)(ren)(ren)(ren)(ren)員(yuan)(yuan)(yuan)(yuan)。

  針對(dui)(dui)(dui)(dui)第(di)一種(zhong)情形,監(jian)察機關根(gen)據政(zheng)(zheng)(zheng)務(wu)處(chu)(chu)(chu)(chu)分(fen)法(fa)(fa)(fa)(fa)從(cong)舊兼從(cong)輕的(de)原則可(ke)以直接對(dui)(dui)(dui)(dui)其成為(wei)(wei)監(jian)察對(dui)(dui)(dui)(dui)象前(qian)(qian)(qian)的(de)違(wei)法(fa)(fa)(fa)(fa)行(xing)為(wei)(wei)給予政(zheng)(zheng)(zheng)務(wu)處(chu)(chu)(chu)(chu)分(fen),這點是明確的(de),因為(wei)(wei)該違(wei)法(fa)(fa)(fa)(fa)行(xing)為(wei)(wei)發生(sheng)時存在《事業單位(wei)工作(zuo)人員處(chu)(chu)(chu)(chu)分(fen)暫行(xing)規定》《國有(you)企業領導人員廉潔從(cong)業若(ruo)干規定》等對(dui)(dui)(dui)(dui)其進行(xing)政(zheng)(zheng)(zheng)務(wu)處(chu)(chu)(chu)(chu)分(fen)的(de)實體(ti)法(fa)(fa)(fa)(fa)依(yi)(yi)據。針對(dui)(dui)(dui)(dui)第(di)二種(zhong)情形,在公(gong)職(zhi)人員成為(wei)(wei)監(jian)察對(dui)(dui)(dui)(dui)象之前(qian)(qian)(qian)僅(jin)僅(jin)是普(pu)通(tong)公(gong)民的(de)情況下,其違(wei)法(fa)(fa)(fa)(fa)行(xing)為(wei)(wei)有(you)可(ke)能(neng)(neng)受行(xing)政(zheng)(zheng)(zheng)法(fa)(fa)(fa)(fa)規或(huo)刑事法(fa)(fa)(fa)(fa)律(lv)等的(de)制約(yue),但國家對(dui)(dui)(dui)(dui)于(yu)普(pu)通(tong)公(gong)民不能(neng)(neng)給予政(zheng)(zheng)(zheng)務(wu)處(chu)(chu)(chu)(chu)分(fen),而且因為(wei)(wei)主體(ti)不適格,其他政(zheng)(zheng)(zheng)務(wu)處(chu)(chu)(chu)(chu)分(fen)類法(fa)(fa)(fa)(fa)規也(ye)不能(neng)(neng)適用于(yu)普(pu)通(tong)公(gong)民。如果行(xing)為(wei)(wei)發生(sheng)時不需要對(dui)(dui)(dui)(dui)其進行(xing)政(zheng)(zheng)(zheng)務(wu)處(chu)(chu)(chu)(chu)分(fen),那么依(yi)(yi)據從(cong)舊兼從(cong)輕的(de)原則,其成為(wei)(wei)公(gong)職(zhi)人員后就不能(neng)(neng)因為(wei)(wei)之前(qian)(qian)(qian)的(de)違(wei)法(fa)(fa)(fa)(fa)行(xing)為(wei)(wei)受到政(zheng)(zheng)(zheng)務(wu)處(chu)(chu)(chu)(chu)分(fen)。

  因(yin)此,本案(an)中,若認為李(li)某挪(nuo)用A公(gong)司資金時(shi)不(bu)是公(gong)職人員(yuan),則應當適用第二種(zhong)情形的(de)處置(zhi)原(yuan)則。但此時(shi)李(li)某作為普(pu)通公(gong)民實施的(de)挪(nuo)用資金行為應當屬于(yu)公(gong)安機關管轄,又因(yin)為已經(jing)超出(chu)追訴時(shi)效,對李(li)某的(de)挪(nuo)用行為只能由該公(gong)司自行處置(zhi),不(bu)能據(ju)此給予(yu)其政務處分。因(yin)此,第一種(zhong)意見不(bu)成立。

  二、如果(guo)依第二種意見認(ren)為李某挪用A公司資(zi)金時不是國家工作人(ren)員,則(ze)不能僅因(yin)為工作內容(rong)的公共屬性認(ren)定(ding)其為公職人(ren)員

  政務處分(fen)法第(di)(di)二(er)條第(di)(di)三(san)款列明(ming),公職(zhi)人(ren)(ren)(ren)(ren)員(yuan)(yuan)是指監察法第(di)(di)十(shi)(shi)五條規定(ding)的人(ren)(ren)(ren)(ren)員(yuan)(yuan),監察法第(di)(di)十(shi)(shi)五條第(di)(di)三(san)項(xiang)及其(qi)(qi)實(shi)施條例第(di)(di)四十(shi)(shi)條第(di)(di)二(er)項(xiang)、第(di)(di)三(san)項(xiang)則明(ming)確了(le)國(guo)(guo)(guo)有(you)控股、參股公司及其(qi)(qi)分(fen)支機構的公職(zhi)人(ren)(ren)(ren)(ren)員(yuan)(yuan)范(fan)圍(wei)。將上述規定(ding)與“兩高(gao)”《關(guan)于辦理國(guo)(guo)(guo)家(jia)出資企業中職(zhi)務犯罪案(an)件具體應用(yong)法律若(ruo)干問(wen)題的意見(jian)》對國(guo)(guo)(guo)家(jia)出資企業中國(guo)(guo)(guo)家(jia)工作(zuo)人(ren)(ren)(ren)(ren)員(yuan)(yuan)的認定(ding)進行對比,可以發(fa)現二(er)者的范(fan)圍(wei)是重合的,即國(guo)(guo)(guo)有(you)控股、參股公司及其(qi)(qi)分(fen)支機構的公職(zhi)人(ren)(ren)(ren)(ren)員(yuan)(yuan)是國(guo)(guo)(guo)家(jia)工作(zuo)人(ren)(ren)(ren)(ren)員(yuan)(yuan)。這類機構中的非(fei)國(guo)(guo)(guo)家(jia)工作(zuo)人(ren)(ren)(ren)(ren)員(yuan)(yuan),不可能因(yin)為(wei)工作(zuo)內容具有(you)公共屬性就認為(wei)其(qi)(qi)是從(cong)事(shi)公務的公職(zhi)人(ren)(ren)(ren)(ren)員(yuan)(yuan),主要理由是:

  從理(li)論上看,首(shou)先,《全國(guo)(guo)(guo)(guo)法(fa)院審(shen)理(li)經(jing)濟犯罪案(an)件(jian)工(gong)作座談會紀要》對(dui)從事公(gong)(gong)務的(de)解釋(shi)很明確,“代表國(guo)(guo)(guo)(guo)家機關、國(guo)(guo)(guo)(guo)有公(gong)(gong)司(si)、企業事業單位、人(ren)(ren)民團體(ti)等履行組(zu)織、領(ling)導、監(jian)督(du)、管(guan)(guan)理(li)等職(zhi)責”,實際上既強(qiang)調(diao)職(zhi)權內容(rong)的(de)公(gong)(gong)共(gong)屬性(組(zu)織、領(ling)導、監(jian)督(du)、管(guan)(guan)理(li)),也強(qiang)調(diao)了職(zhi)權來源(yuan)(yuan)的(de)公(gong)(gong)共(gong)屬性(代表國(guo)(guo)(guo)(guo)家機關);其次(ci),刑法(fa)將(jiang)受委托(tuo)管(guan)(guan)理(li)、經(jing)營(ying)國(guo)(guo)(guo)(guo)有財產的(de)人(ren)(ren)員(yuan)與國(guo)(guo)(guo)(guo)家工(gong)作人(ren)(ren)員(yuan)并列為(wei)(wei)(wei)貪污罪的(de)主體(ti),是(shi)因(yin)為(wei)(wei)(wei)受委托(tuo)管(guan)(guan)理(li)、經(jing)營(ying)國(guo)(guo)(guo)(guo)有財產這(zhe)樣一個(ge)工(gong)作內容(rong)具有公(gong)(gong)共(gong)屬性,但(dan)又沒有將(jiang)受委托(tuo)管(guan)(guan)理(li)、經(jing)營(ying)國(guo)(guo)(guo)(guo)有財產的(de)人(ren)(ren)員(yuan)列為(wei)(wei)(wei)國(guo)(guo)(guo)(guo)家工(gong)作人(ren)(ren)員(yuan),顯(xian)然(ran)是(shi)因(yin)為(wei)(wei)(wei)這(zhe)類人(ren)(ren)員(yuan)的(de)職(zhi)權來源(yuan)(yuan)不(bu)具備公(gong)(gong)共(gong)屬性。

  從實踐上(shang)看,存在一些國有控股(gu)、參股(gu)公(gong)(gong)司實際(ji)上(shang)是由其(qi)他(ta)非國有成分股(gu)東實際(ji)管理、經營,包括(kuo)出(chu)(chu)納在內的(de)公(gong)(gong)司工作人員均由實際(ji)管理者(zhe)自主聘用,國有股(gu)東僅(jin)僅(jin)參與分紅的(de)情況,此時很明顯不(bu)能因為該公(gong)(gong)司的(de)出(chu)(chu)納所監督、管理的(de)部分財產歸屬于國有就(jiu)將其(qi)視(shi)為公(gong)(gong)職人員。

  本案中,第(di)二(er)種意見認(ren)為李(li)某(mou)不屬于國家(jia)工作人員(yuan),又認(ren)為其(qi)是公(gong)(gong)職人員(yuan),顯然是自相(xiang)矛盾的。若(ruo)李(li)某(mou)并非受某(mou)事(shi)業單位(wei)委派到A公(gong)(gong)司工作,盡管(guan)其(qi)從事(shi)出(chu)納工作,也僅僅是按照A公(gong)(gong)司的授權(quan),并非在(zai)從事(shi)公(gong)(gong)務。因此(ci),第(di)二(er)種意見也不成立。

  三、按照刑(xing)法(fa)和相關司法(fa)解釋的規定,李(li)某實施挪用(yong)行為時系事業單位(wei)委派(pai)到非國(guo)(guo)有公司從事公務的人員,應以國(guo)(guo)家工作人員論

  刑法第九十三條(tiao)規定(ding)(ding),“國(guo)(guo)家(jia)(jia)機(ji)關(guan)、國(guo)(guo)有(you)公(gong)司(si)、企(qi)業(ye)(ye)(ye)、事(shi)(shi)業(ye)(ye)(ye)單位(wei)(wei)(wei)委(wei)派到非(fei)國(guo)(guo)有(you)公(gong)司(si)、企(qi)業(ye)(ye)(ye)、事(shi)(shi)業(ye)(ye)(ye)單位(wei)(wei)(wei)、社會(hui)團體(ti)(ti)從(cong)事(shi)(shi)公(gong)務(wu)的(de)(de)(de)人(ren)員(yuan)(yuan),以(yi)(yi)國(guo)(guo)家(jia)(jia)工作人(ren)員(yuan)(yuan)論(lun)。”《全國(guo)(guo)法院(yuan)審理經濟犯(fan)罪(zui)(zui)案(an)件工作座談會(hui)紀要(yao)(yao)》明確,委(wei)派,即委(wei)任(ren)、派遣,其(qi)形式(shi)多種(zhong)多樣(yang),如任(ren)命(ming)、指派、提名、批準等。不論(lun)被委(wei)派的(de)(de)(de)人(ren)身份(fen)如何,只要(yao)(yao)是(shi)接受國(guo)(guo)家(jia)(jia)機(ji)關(guan)、國(guo)(guo)有(you)公(gong)司(si)、企(qi)業(ye)(ye)(ye)、事(shi)(shi)業(ye)(ye)(ye)單位(wei)(wei)(wei)委(wei)派,代表國(guo)(guo)家(jia)(jia)機(ji)關(guan)、國(guo)(guo)有(you)公(gong)司(si)、企(qi)業(ye)(ye)(ye)、事(shi)(shi)業(ye)(ye)(ye)單位(wei)(wei)(wei)到非(fei)國(guo)(guo)有(you)公(gong)司(si)、企(qi)業(ye)(ye)(ye)、事(shi)(shi)業(ye)(ye)(ye)單位(wei)(wei)(wei)、社會(hui)團體(ti)(ti)中行使管理職(zhi)權,都可(ke)以(yi)(yi)認定(ding)(ding)為國(guo)(guo)家(jia)(jia)機(ji)關(guan)、國(guo)(guo)有(you)公(gong)司(si)、企(qi)業(ye)(ye)(ye)、事(shi)(shi)業(ye)(ye)(ye)單位(wei)(wei)(wei)委(wei)派到非(fei)國(guo)(guo)有(you)公(gong)司(si)、企(qi)業(ye)(ye)(ye)、事(shi)(shi)業(ye)(ye)(ye)單位(wei)(wei)(wei)、社會(hui)團體(ti)(ti)從(cong)事(shi)(shi)公(gong)務(wu)的(de)(de)(de)人(ren)員(yuan)(yuan)。《關(guan)于辦理國(guo)(guo)家(jia)(jia)出資(zi)企(qi)業(ye)(ye)(ye)中職(zhi)務(wu)犯(fan)罪(zui)(zui)案(an)件具體(ti)(ti)應用(yong)法律若干(gan)問題(ti)的(de)(de)(de)意見(jian)》進一步明確,“具體(ti)(ti)的(de)(de)(de)任(ren)命(ming)機(ji)構和程序,不影響國(guo)(guo)家(jia)(jia)工作人(ren)員(yuan)(yuan)的(de)(de)(de)認定(ding)(ding)。”

  需要注意(yi)的(de)(de)是(shi),司法(fa)解釋僅僅列舉了(le)常見的(de)(de)委派形式,實(shi)踐中(zhong)不應拘泥于(yu)此,只要體現(xian)了(le)國有單(dan)(dan)(dan)位的(de)(de)意(yi)志,代表其行(xing)使管理職(zhi)權(quan)(quan),就應當認定(ding)為從事(shi)公(gong)務。本案中(zhong),李(li)(li)某(mou)雖然(ran)是(shi)A公(gong)司招(zhao)(zhao)聘(pin)(pin),但招(zhao)(zhao)聘(pin)(pin)系(xi)該事(shi)業單(dan)(dan)(dan)位的(de)(de)授權(quan)(quan)委托行(xing)為,李(li)(li)某(mou)是(shi)按(an)照該事(shi)業單(dan)(dan)(dan)位雇員(yuan)制管理辦法(fa)管理的(de)(de)人(ren)(ren)員(yuan),且年終(zhong)考核(he)均由該事(shi)業單(dan)(dan)(dan)位人(ren)(ren)事(shi)處統一決(jue)定(ding),因此,李(li)(li)某(mou)實(shi)施挪用行(xing)為時系(xi)該事(shi)業單(dan)(dan)(dan)位委派到非國有公(gong)司從事(shi)公(gong)務的(de)(de)人(ren)(ren)員(yuan),應當以國家工作(zuo)人(ren)(ren)員(yuan)論。按(an)照刑(xing)法(fa)第(di)二(er)百七十二(er)條第(di)二(er)款(kuan)的(de)(de)規(gui)定(ding),李(li)(li)某(mou)的(de)(de)行(xing)為構成挪用公(gong)款(kuan)且涉嫌(xian)職(zhi)務犯罪,鑒于(yu)已(yi)過追訴時效,可(ke)依據(ju)政務處分法(fa)和《事(shi)業單(dan)(dan)(dan)位工作(zuo)人(ren)(ren)員(yuan)處分暫(zan)行(xing)規(gui)定(ding)》等給予(yu)其政務處分。
