怎樣做到定性準確
定(ding)(ding)性(xing)(xing)是(shi)(shi)指確(que)定(ding)(ding)相關違(wei)(wei)紀違(wei)(wei)法行為具體性(xing)(xing)質的過程。定(ding)(ding)性(xing)(xing)準(zhun)確(que)作為審理工作“二十四字”方針之一,是(shi)(shi)事關案件質量的重要問(wen)題(ti)。定(ding)(ding)性(xing)(xing)不準(zhun)對案件質量的影響(xiang)是(shi)(shi)多方面(mian)的,有的把握不準(zhun)錯(cuo)與(yu)非錯(cuo),有的混淆此錯(cuo)與(yu)彼錯(cuo),可能影響(xiang)處理檔次(ci)。筆者認(ren)為,做好定(ding)(ding)性(xing)(xing)工作應(ying)做到以下(xia)幾點。
一要(yao)(yao)聚(ju)焦(jiao)政(zheng)(zheng)(zheng)治屬性(xing),確保理念對標。定性(xing)要(yao)(yao)強化(hua)政(zheng)(zheng)(zheng)治敏銳(rui)性(xing)和鑒別力,聚(ju)焦(jiao)黨中央重大決(jue)策部署,精準識別違(wei)紀(ji)違(wei)法行(xing)為(wei)(wei)本質。如對表(biao)面上(shang)符合違(wei)反工作紀(ji)律的行(xing)為(wei)(wei),要(yao)(yao)區分(fen)主觀上(shang)是(shi)否明知(zhi)(zhi)或者應當(dang)知(zhi)(zhi)曉(xiao)其行(xing)為(wei)(wei)可能(neng)造成(cheng)的政(zheng)(zheng)(zheng)治危害性(xing),是(shi)管理不力還是(shi)政(zheng)(zheng)(zheng)治意識薄(bo)弱(ruo),是(shi)造成(cheng)一般(ban)后果還是(shi)產生不良政(zheng)(zheng)(zheng)治影響等(deng)不同(tong)情(qing)形(xing),從政(zheng)(zheng)(zheng)治高度把握違(wei)紀(ji)違(wei)法行(xing)為(wei)(wei)本質,精準認定違(wei)反政(zheng)(zheng)(zheng)治紀(ji)律和政(zheng)(zheng)(zheng)治規(gui)矩問題。同(tong)時,也要(yao)(yao)防止認定違(wei)反政(zheng)(zheng)(zheng)治紀(ji)律和政(zheng)(zheng)(zheng)治規(gui)矩問題泛化(hua)。
二要聚焦構(gou)成(cheng)(cheng)要素,把握“入錯”標(biao)準。錯與非錯是定性的(de)前提。黨(dang)(dang)紀(ji)處(chu)分(fen)條(tiao)例(li)、政(zheng)務(wu)處(chu)分(fen)法規(gui)定了違紀(ji)違法行為(wei)具體表現情形(xing),并從違規(gui)和有(you)(you)責兩個方面明(ming)確行為(wei)的(de)構(gou)成(cheng)(cheng)要素。有(you)(you)些(xie)行為(wei)要求(qiu)特定的(de)主(zhu)體,如(ru)不重(zhong)視家(jia)風建(jian)設、不按規(gui)定報(bao)(bao)告個人(ren)有(you)(you)關(guan)事(shi)項(xiang)行為(wei),依據黨(dang)(dang)紀(ji)處(chu)分(fen)條(tiao)例(li)第(di)(di)(di)一百三十(shi)六條(tiao)、政(zheng)務(wu)處(chu)分(fen)法第(di)(di)(di)二十(shi)九(jiu)條(tiao)規(gui)定,要求(qiu)行為(wei)人(ren)必(bi)須是黨(dang)(dang)員領(ling)導干部(bu)或負(fu)有(you)(you)報(bao)(bao)告義(yi)務(wu)的(de)公職(zhi)人(ren)員。有(you)(you)的(de)行為(wei)要求(qiu)造成(cheng)(cheng)不良影響(xiang)等后果,如(ru)違反黨(dang)(dang)的(de)優良傳統和工作慣例(li)、參(can)與迷信活動,依據黨(dang)(dang)紀(ji)處(chu)分(fen)條(tiao)例(li)第(di)(di)(di)六十(shi)九(jiu)條(tiao)、政(zheng)務(wu)處(chu)分(fen)法第(di)(di)(di)四十(shi)條(tiao)第(di)(di)(di)一款第(di)(di)(di)(二)項(xiang)規(gui)定,均(jun)要求(qiu)必(bi)須造成(cheng)(cheng)不良影響(xiang)。
三(san)要(yao)(yao)熟悉關聯條(tiao)規(gui)(gui)(gui),確定(ding)具(ju)體違(wei)(wei)規(gui)(gui)(gui)點。黨紀處分(fen)(fen)條(tiao)例(li)、政務處分(fen)(fen)法(fa)對部分(fen)(fen)行(xing)(xing)為(wei)要(yao)(yao)求“違(wei)(wei)反有關規(gui)(gui)(gui)定(ding)”,主(zhu)(zhu)要(yao)(yao)集(ji)中在違(wei)(wei)反組(zu)織紀律(lv)(lv)、廉潔紀律(lv)(lv)行(xing)(xing)為(wei),主(zhu)(zhu)要(yao)(yao)表(biao)現在規(gui)(gui)(gui)范特定(ding)主(zhu)(zhu)體的履職從(cong)業行(xing)(xing)為(wei),在定(ding)性中要(yao)(yao)根據相關規(gui)(gui)(gui)范查找行(xing)(xing)為(wei)的具(ju)體違(wei)(wei)規(gui)(gui)(gui)點。如政務處分(fen)(fen)法(fa)第三(san)十六條(tiao)規(gui)(gui)(gui)定(ding)的“違(wei)(wei)反規(gui)(gui)(gui)定(ding)從(cong)事(shi)或者參與營利性活(huo)動”,主(zhu)(zhu)要(yao)(yao)違(wei)(wei)反公務員法(fa)、《關于(yu)黨政機關興(xing)辦經濟實體和黨政機關干部從(cong)事(shi)經營活(huo)動問(wen)題的通(tong)知(zhi)》等有關規(gui)(gui)(gui)定(ding)。
四要強(qiang)化(hua)系統思維,全面(mian)體(ti)現(xian)(xian)行(xing)為(wei)(wei)(wei)(wei)(wei)本(ben)質。違紀違法行(xing)為(wei)(wei)(wei)(wei)(wei)具體(ti)表現(xian)(xian)形式(shi)紛繁復雜,在(zai)定(ding)性(xing)(xing)中要避免“對號入座”僵化(hua)思維,著眼于全面(mian)體(ti)現(xian)(xian)行(xing)為(wei)(wei)(wei)(wei)(wei)的特征和(he)本(ben)質,對競合(he)、牽連、連續、繼(ji)續等疑(yi)難(nan)復雜行(xing)為(wei)(wei)(wei)(wei)(wei)區分(fen)情(qing)形、精準定(ding)性(xing)(xing)。如(ru)設(she)立(li)(li)“小金(jin)庫”后(hou)濫發(fa)津(jin)補貼行(xing)為(wei)(wei)(wei)(wei)(wei),如(ru)設(she)立(li)(li)“小金(jin)庫”行(xing)為(wei)(wei)(wei)(wei)(wei)與濫發(fa)津(jin)補貼行(xing)為(wei)(wei)(wei)(wei)(wei)沒有牽連關(guan)系,時(shi)間間隔較久、關(guan)聯性(xing)(xing)不強(qiang),可分(fen)別認(ren)定(ding)為(wei)(wei)(wei)(wei)(wei)違反廉潔(jie)紀律和(he)工(gong)作(zuo)紀律合(he)并(bing)處(chu)理;如(ru)設(she)立(li)(li)的目(mu)的是為(wei)(wei)(wei)(wei)(wei)了違規發(fa)放,存在(zai)較強(qiang)的牽連關(guan)系,可認(ren)定(ding)為(wei)(wei)(wei)(wei)(wei)濫發(fa)津(jin)補貼行(xing)為(wei)(wei)(wei)(wei)(wei),設(she)立(li)(li)行(xing)為(wei)(wei)(wei)(wei)(wei)作(zuo)為(wei)(wei)(wei)(wei)(wei)情(qing)節(jie)表述(shu)。同時(shi),要善于透過現(xian)(xian)象把握(wo)行(xing)為(wei)(wei)(wei)(wei)(wei)本(ben)質,對黨(dang)紀處(chu)分(fen)條(tiao)(tiao)例、政(zheng)務處(chu)分(fen)法相(xiang)關(guan)條(tiao)(tiao)款沒有明確規定(ding)的行(xing)為(wei)(wei)(wei)(wei)(wei),要結合(he)行(xing)為(wei)(wei)(wei)(wei)(wei)的違規性(xing)(xing)和(he)危(wei)害性(xing)(xing),適用兜底(di)條(tiao)(tiao)款予(yu)以處(chu)理。
五要紀法情(qing)理貫通融合,保(bao)障被審(shen)查(cha)(cha)調查(cha)(cha)人(ren)(ren)的(de)合法權益。要堅(jian)持實事求是,充(chong)分聽取被審(shen)查(cha)(cha)調查(cha)(cha)人(ren)(ren)關于定(ding)性(xing)的(de)辯解。如對(dui)發(fa)生在(zai)2016年(nian)1月1日(ri)之(zhi)前的(de)對(dui)抗(kang)組織審(shen)查(cha)(cha)行(xing)為(wei),鑒(jian)于2003年(nian)《條(tiao)例》未將該行(xing)為(wei)認定(ding)為(wei)違紀,從有利(li)于行(xing)為(wei)人(ren)(ren)角度考慮(lv),在(zai)事實見面、審(shen)理等材料(liao)中均不宜認定(ding)為(wei)違紀行(xing)為(wei),可作情(qing)節表述。必要時,在(zai)審(shen)查(cha)(cha)調查(cha)(cha)報告和審(shen)理文(wen)書中就疑難(nan)、復雜(za)行(xing)為(wei)的(de)定(ding)性(xing)進行(xing)專(zhuan)題分析(xi),強化定(ding)性(xing)的(de)說理性(xing)和說服力。(許(xu)展 上(shang)官良(liang)玉)
