  【典型案例】

  華(hua)(hua)某,W市某國有(you)企(qi)業工程管理部(bu)副經理。須某,A工程公司(私營企(qi)業)老(lao)板。華(hua)(hua)某某,華(hua)(hua)某的特定關系人。

  2013年(nian)(nian)(nian)至2022年(nian)(nian)(nian),華(hua)(hua)某(mou)(mou)(mou)(mou)(mou)利(li)用職務(wu)便(bian)利(li),為(wei)(wei)須某(mou)(mou)(mou)(mou)(mou)在承接工(gong)(gong)(gong)(gong)程、工(gong)(gong)(gong)(gong)程量審核、工(gong)(gong)(gong)(gong)程款結(jie)算(suan)等(deng)方(fang)面提供幫助。2020年(nian)(nian)(nian)11月,華(hua)(hua)某(mou)(mou)(mou)(mou)(mou)某(mou)(mou)(mou)(mou)(mou)想購買W市某(mou)(mou)(mou)(mou)(mou)小(xiao)區(qu)房產(chan),華(hua)(hua)某(mou)(mou)(mou)(mou)(mou)得(de)知該項目的土(tu)(tu)建(jian)施工(gong)(gong)(gong)(gong)方(fang)系A工(gong)(gong)(gong)(gong)程公司,遂(sui)詢(xun)問須某(mou)(mou)(mou)(mou)(mou)是否有“工(gong)(gong)(gong)(gong)抵房”(開(kai)發(fa)(fa)商(shang)用其開(kai)發(fa)(fa)的房產(chan)沖(chong)抵對土(tu)(tu)建(jian)施工(gong)(gong)(gong)(gong)方(fang)的工(gong)(gong)(gong)(gong)程款,土(tu)(tu)建(jian)施工(gong)(gong)(gong)(gong)方(fang)拿到“工(gong)(gong)(gong)(gong)抵房”后再轉(zhuan)賣給(gei)第三人回籠資金)出售。須某(mou)(mou)(mou)(mou)(mou)表示(shi),華(hua)(hua)某(mou)(mou)(mou)(mou)(mou)某(mou)(mou)(mou)(mou)(mou)可(ke)以自行至開(kai)發(fa)(fa)商(shang)處選房,自己再以A工(gong)(gong)(gong)(gong)程公司“工(gong)(gong)(gong)(gong)抵房”的名義轉(zhuan)售給(gei)華(hua)(hua)某(mou)(mou)(mou)(mou)(mou)某(mou)(mou)(mou)(mou)(mou)。華(hua)(hua)某(mou)(mou)(mou)(mou)(mou)某(mou)(mou)(mou)(mou)(mou)隨即選定該小(xiao)區(qu)一套面積(ji)為(wei)(wei)145平方(fang)米的商(shang)品(pin)房,并告(gao)知須某(mou)(mou)(mou)(mou)(mou)。須某(mou)(mou)(mou)(mou)(mou)經詢(xun)問開(kai)發(fa)(fa)商(shang)該房屋價格(ge),得(de)知該小(xiao)區(qu)相同樓層(ceng)相同戶型的商(shang)品(pin)房市場(chang)銷售價為(wei)(wei)155萬(wan)(wan)元。隨后,須某(mou)(mou)(mou)(mou)(mou)將(jiang)該價格(ge)告(gao)知華(hua)(hua)某(mou)(mou)(mou)(mou)(mou)某(mou)(mou)(mou)(mou)(mou),并表示(shi)華(hua)(hua)某(mou)(mou)(mou)(mou)(mou)某(mou)(mou)(mou)(mou)(mou)只需支付購房款140萬(wan)(wan)元。

  2020年12月,華(hua)(hua)(hua)某某與(yu)(yu)開(kai)發(fa)商(shang)簽訂(ding)商(shang)品房買(mai)賣合(he)同(tong),載明房屋銷售價(jia)155萬(wan)元(yuan)。同(tong)時,A工(gong)程(cheng)(cheng)(cheng)公(gong)司、開(kai)發(fa)商(shang)與(yu)(yu)華(hua)(hua)(hua)某某三方簽訂(ding)房屋沖抵工(gong)程(cheng)(cheng)(cheng)款(kuan)協議,約定(ding)(ding)華(hua)(hua)(hua)某某與(yu)(yu)開(kai)發(fa)商(shang)所(suo)簽的商(shang)品房買(mai)賣合(he)同(tong)視為A工(gong)程(cheng)(cheng)(cheng)公(gong)司與(yu)(yu)開(kai)發(fa)商(shang)結清155萬(wan)元(yuan)的工(gong)程(cheng)(cheng)(cheng)款(kuan),華(hua)(hua)(hua)某某應支付(fu)的購房款(kuan)直(zhi)接向A工(gong)程(cheng)(cheng)(cheng)公(gong)司支付(fu)。合(he)同(tong)簽訂(ding)后(hou),華(hua)(hua)(hua)某某將合(he)同(tong)價(jia)與(yu)(yu)優(you)惠價(jia)告(gao)知華(hua)(hua)(hua)某。最終,華(hua)(hua)(hua)某某根(gen)據事先約定(ding)(ding)支付(fu)須某140萬(wan)元(yuan)。

  【分歧意見】

  本案(an)中,對于(yu)華某的行為是否構成(cheng)受賄,存(cun)在兩種不(bu)同(tong)意見。

  第一種意見認為:華某(mou)(mou)利(li)用(yong)職務便(bian)利(li),以(yi)140萬(wan)元優惠價格幫助華某(mou)(mou)某(mou)(mou)從(cong)須某(mou)(mou)處(chu)購買房(fang)(fang)產,價格約為市場(chang)價155萬(wan)元的9折左右,沒有明顯(xian)低(di)于(yu)(yu)市場(chang)價。根據“兩高”《關(guan)于(yu)(yu)辦理受(shou)賄(hui)刑(xing)事案件適用(yong)法律若干問(wen)(wen)題的意見》(以(yi)下簡稱《意見》)中關(guan)于(yu)(yu)以(yi)交(jiao)易(yi)形(xing)式收受(shou)賄(hui)賂相(xiang)關(guan)問(wen)(wen)題的規定,“以(yi)明顯(xian)低(di)于(yu)(yu)市場(chang)的價格向請托(tuo)人購買房(fang)(fang)屋、汽車等物品的,以(yi)受(shou)賄(hui)論處(chu)”,華某(mou)(mou)某(mou)(mou)購房(fang)(fang)價格未(wei)明顯(xian)低(di)于(yu)(yu)市場(chang)價,因此不能(neng)認定華某(mou)(mou)構成受(shou)賄(hui)。

  第二種(zhong)意見認(ren)為(wei):須某以(yi)其對開發商享(xiang)有的155萬(wan)元(yuan)的工程款(kuan)為(wei)華(hua)(hua)某某沖(chong)抵(di)購房款(kuan),華(hua)(hua)某某應(ying)向須某支付155萬(wan)元(yuan)。但須某為(wei)向華(hua)(hua)某表示(shi)感謝,實際(ji)收(shou)取(qu)華(hua)(hua)某某140萬(wan)元(yuan),即免(mian)除了華(hua)(hua)某某15萬(wan)元(yuan)的債務(wu)(wu),應(ying)認(ren)定(ding)華(hua)(hua)某以(yi)債務(wu)(wu)免(mian)除形式收(shou)受須某賄賂15萬(wan)元(yuan)。

  【評析意見】

  實踐中,受賄的(de)方式逐漸從傳統的(de)收受實物(wu)演變為收受財(cai)產性(xing)利益,且更(geng)多地通(tong)過(guo)合法(fa)(fa)形式達到(dao)非法(fa)(fa)目(mu)的(de)。對于這類新型受賄案(an)(an)件,應牢牢抓住受賄犯罪(zui)權(quan)錢交易的(de)本質,結合相關司法(fa)(fa)解釋,善于識破各種(zhong)新型腐敗(bai)和(he)隱性(xing)腐敗(bai)問題,精準打(da)擊。本案(an)(an)中,筆者(zhe)贊同第二種(zhong)意見,具體(ti)分(fen)析如下:

  一(yi)、根據本案(an)事實,華(hua)某的行(xing)為不適用房產交易(yi)型受賄的相(xiang)關司法解釋規定

  根據《意(yi)見(jian)》規定(ding),國家工作(zuo)(zuo)人(ren)員利(li)(li)(li)用職務上的(de)(de)便利(li)(li)(li)為請(qing)(qing)托人(ren)謀取利(li)(li)(li)益,以明(ming)顯低于市(shi)場(chang)的(de)(de)價(jia)(jia)格(ge)向(xiang)請(qing)(qing)托人(ren)購買房屋(wu)、汽(qi)車等物(wu)品的(de)(de),以受賄(hui)論處。因此,成立房產交(jiao)易(yi)型(xing)受賄(hui)必須滿(man)足以下幾(ji)個條(tiao)件(jian):第(di)一(yi),國家工作(zuo)(zuo)人(ren)員利(li)(li)(li)用職務上的(de)(de)便利(li)(li)(li)為請(qing)(qing)托人(ren)謀取利(li)(li)(li)益;第(di)二,雙方存在房產交(jiao)易(yi)行為;第(di)三,交(jiao)易(yi)價(jia)(jia)格(ge)必須明(ming)顯低于市(shi)場(chang)價(jia)(jia)格(ge)。《意(yi)見(jian)》對(dui)交(jiao)易(yi)型(xing)受賄(hui)的(de)(de)“市(shi)場(chang)價(jia)(jia)格(ge)”作(zuo)(zuo)了明(ming)確解釋,“包括商(shang)品經(jing)營者事(shi)先(xian)設(she)定(ding)的(de)(de)不(bu)針(zhen)對(dui)特定(ding)人(ren)的(de)(de)最低優惠價(jia)(jia)格(ge)。根據商(shang)品經(jing)營者事(shi)先(xian)設(she)定(ding)的(de)(de)各(ge)種優惠交(jiao)易(yi)條(tiao)件(jian),以優惠價(jia)(jia)格(ge)購買商(shang)品的(de)(de),不(bu)屬(shu)于受賄(hui)”。

  實踐(jian)中,“工(gong)(gong)(gong)(gong)抵(di)(di)房(fang)(fang)”交(jiao)易(yi)具有特(te)殊性(xing),土建施工(gong)(gong)(gong)(gong)方(fang)為(wei)了回籠資金(jin)(jin),往往會通(tong)過低(di)價(jia)(jia)(jia)(jia)銷售(shou)的(de)(de)方(fang)式(shi)盡(jin)快(kuai)達成交(jiao)易(yi)。所以,在(zai)判(pan)斷“工(gong)(gong)(gong)(gong)抵(di)(di)房(fang)(fang)”交(jiao)易(yi)價(jia)(jia)(jia)(jia)格是(shi)(shi)否明(ming)顯(xian)低(di)于(yu)市場價(jia)(jia)(jia)(jia)格時,不(bu)能完全按照普通(tong)商品房(fang)(fang)的(de)(de)市場價(jia)(jia)(jia)(jia)格進(jin)行(xing)評判(pan),而是(shi)(shi)應當(dang)根據土建施工(gong)(gong)(gong)(gong)方(fang)在(zai)該(gai)小(xiao)區的(de)(de)其(qi)他(ta)“工(gong)(gong)(gong)(gong)抵(di)(di)房(fang)(fang)”的(de)(de)交(jiao)易(yi)價(jia)(jia)(jia)(jia)、施工(gong)(gong)(gong)(gong)方(fang)低(di)價(jia)(jia)(jia)(jia)售(shou)房(fang)(fang)的(de)(de)原因以及交(jiao)易(yi)雙方(fang)的(de)(de)關系(xi)等因素綜合判(pan)斷。然而,本案中,該(gai)“工(gong)(gong)(gong)(gong)抵(di)(di)房(fang)(fang)”并(bing)非事(shi)(shi)先(xian)存(cun)在(zai),而是(shi)(shi)華(hua)(hua)(hua)某(mou)和(he)華(hua)(hua)(hua)某(mou)某(mou)選定(ding)(ding)后,由須某(mou)包裝成“工(gong)(gong)(gong)(gong)抵(di)(di)房(fang)(fang)”的(de)(de)形(xing)式(shi)銷售(shou)給華(hua)(hua)(hua)某(mou)的(de)(de)特(te)定(ding)(ding)關系(xi)人華(hua)(hua)(hua)某(mou)某(mou)。A工(gong)(gong)(gong)(gong)程(cheng)公司在(zai)該(gai)小(xiao)區沒(mei)有其(qi)他(ta)“工(gong)(gong)(gong)(gong)抵(di)(di)房(fang)(fang)”,所謂(wei)的(de)(de)優(you)惠價(jia)(jia)(jia)(jia)格也是(shi)(shi)為(wei)華(hua)(hua)(hua)某(mou)某(mou)量身定(ding)(ding)制,不(bu)存(cun)在(zai)事(shi)(shi)先(xian)設定(ding)(ding)的(de)(de)不(bu)針對特(te)定(ding)(ding)人的(de)(de)優(you)惠價(jia)(jia)(jia)(jia)格。須某(mou)愿意虧本交(jiao)易(yi)是(shi)(shi)為(wei)了感謝(xie)華(hua)(hua)(hua)某(mou)的(de)(de)幫助,而不(bu)是(shi)(shi)為(wei)了回籠資金(jin)(jin)等其(qi)他(ta)正(zheng)當(dang)事(shi)(shi)由。因此,須某(mou)與華(hua)(hua)(hua)某(mou)、華(hua)(hua)(hua)某(mou)某(mou)間并(bing)非正(zheng)常的(de)(de)“工(gong)(gong)(gong)(gong)抵(di)(di)房(fang)(fang)”交(jiao)易(yi)行(xing)為(wei),故不(bu)能適(shi)用(yong)房(fang)(fang)產交(jiao)易(yi)型(xing)受賄(hui)相關司法解釋進(jin)而認定(ding)(ding)華(hua)(hua)(hua)某(mou)不(bu)構成受賄(hui)犯(fan)罪。

  二、須(xu)某(mou)少收華(hua)某(mou)某(mou)15萬元(yuan)的行為構成債務免除

  判斷華某(mou)(mou)(mou)(mou)(mou)(mou)(mou)(mou)(mou)(mou)的(de)(de)(de)行為是否構(gou)成(cheng)受(shou)賄(hui),首先(xian)要厘清(qing)華某(mou)(mou)(mou)(mou)(mou)(mou)(mou)(mou)(mou)(mou)與須某(mou)(mou)(mou)(mou)(mou)(mou)(mou)(mou)(mou)(mou)、開(kai)(kai)(kai)發(fa)商(shang)(shang)(shang)、華某(mou)(mou)(mou)(mou)(mou)(mou)(mou)(mou)(mou)(mou)某(mou)(mou)(mou)(mou)(mou)(mou)(mou)(mou)(mou)(mou)四者(zhe)的(de)(de)(de)關系(xi)(xi)。A工(gong)(gong)(gong)(gong)(gong)程(cheng)(cheng)公司(si)(si)(si)(si)與開(kai)(kai)(kai)發(fa)商(shang)(shang)(shang)之間(jian)存(cun)在(zai)建設工(gong)(gong)(gong)(gong)(gong)程(cheng)(cheng)承攬(lan)關系(xi)(xi),即(ji)A工(gong)(gong)(gong)(gong)(gong)程(cheng)(cheng)公司(si)(si)(si)(si)負(fu)責承包建設房產(chan)工(gong)(gong)(gong)(gong)(gong)程(cheng)(cheng),開(kai)(kai)(kai)發(fa)商(shang)(shang)(shang)需向(xiang)(xiang)A工(gong)(gong)(gong)(gong)(gong)程(cheng)(cheng)公司(si)(si)(si)(si)支付(fu)工(gong)(gong)(gong)(gong)(gong)程(cheng)(cheng)款。而華某(mou)(mou)(mou)(mou)(mou)(mou)(mou)(mou)(mou)(mou)某(mou)(mou)(mou)(mou)(mou)(mou)(mou)(mou)(mou)(mou)與開(kai)(kai)(kai)發(fa)商(shang)(shang)(shang)間(jian)存(cun)在(zai)房屋(wu)買賣關系(xi)(xi),即(ji)華某(mou)(mou)(mou)(mou)(mou)(mou)(mou)(mou)(mou)(mou)某(mou)(mou)(mou)(mou)(mou)(mou)(mou)(mou)(mou)(mou)應(ying)(ying)向(xiang)(xiang)開(kai)(kai)(kai)發(fa)商(shang)(shang)(shang)支付(fu)購房款,開(kai)(kai)(kai)發(fa)商(shang)(shang)(shang)應(ying)(ying)向(xiang)(xiang)華某(mou)(mou)(mou)(mou)(mou)(mou)(mou)(mou)(mou)(mou)某(mou)(mou)(mou)(mou)(mou)(mou)(mou)(mou)(mou)(mou)交付(fu)房產(chan)。須某(mou)(mou)(mou)(mou)(mou)(mou)(mou)(mou)(mou)(mou)的(de)(de)(de)A工(gong)(gong)(gong)(gong)(gong)程(cheng)(cheng)公司(si)(si)(si)(si)、開(kai)(kai)(kai)發(fa)商(shang)(shang)(shang)與華某(mou)(mou)(mou)(mou)(mou)(mou)(mou)(mou)(mou)(mou)某(mou)(mou)(mou)(mou)(mou)(mou)(mou)(mou)(mou)(mou)簽(qian)訂房屋(wu)沖(chong)抵工(gong)(gong)(gong)(gong)(gong)程(cheng)(cheng)款協議(yi)后,三方的(de)(de)(de)債(zhai)(zhai)權(quan)債(zhai)(zhai)務(wu)(wu)關系(xi)(xi)發(fa)生了變(bian)化。開(kai)(kai)(kai)發(fa)商(shang)(shang)(shang)與華某(mou)(mou)(mou)(mou)(mou)(mou)(mou)(mou)(mou)(mou)某(mou)(mou)(mou)(mou)(mou)(mou)(mou)(mou)(mou)(mou)間(jian)仍然存(cun)在(zai)房屋(wu)買賣關系(xi)(xi),但(dan)開(kai)(kai)(kai)發(fa)商(shang)(shang)(shang)把其(qi)對華某(mou)(mou)(mou)(mou)(mou)(mou)(mou)(mou)(mou)(mou)某(mou)(mou)(mou)(mou)(mou)(mou)(mou)(mou)(mou)(mou)享有的(de)(de)(de)債(zhai)(zhai)權(quan)轉(zhuan)讓(rang)給了A工(gong)(gong)(gong)(gong)(gong)程(cheng)(cheng)公司(si)(si)(si)(si),隨(sui)著債(zhai)(zhai)權(quan)的(de)(de)(de)轉(zhuan)讓(rang),開(kai)(kai)(kai)發(fa)商(shang)(shang)(shang)與A工(gong)(gong)(gong)(gong)(gong)程(cheng)(cheng)公司(si)(si)(si)(si)的(de)(de)(de)155萬元(yuan)債(zhai)(zhai)權(quan)債(zhai)(zhai)務(wu)(wu)結清(qing),此時華某(mou)(mou)(mou)(mou)(mou)(mou)(mou)(mou)(mou)(mou)某(mou)(mou)(mou)(mou)(mou)(mou)(mou)(mou)(mou)(mou)應(ying)(ying)對A工(gong)(gong)(gong)(gong)(gong)程(cheng)(cheng)公司(si)(si)(si)(si)承擔155萬元(yuan)的(de)(de)(de)債(zhai)(zhai)務(wu)(wu)。A工(gong)(gong)(gong)(gong)(gong)程(cheng)(cheng)公司(si)(si)(si)(si)負(fu)責人須某(mou)(mou)(mou)(mou)(mou)(mou)(mou)(mou)(mou)(mou)最后僅收取華某(mou)(mou)(mou)(mou)(mou)(mou)(mou)(mou)(mou)(mou)某(mou)(mou)(mou)(mou)(mou)(mou)(mou)(mou)(mou)(mou)140萬元(yuan),即(ji)免(mian)除(chu)了華某(mou)(mou)(mou)(mou)(mou)(mou)(mou)(mou)(mou)(mou)某(mou)(mou)(mou)(mou)(mou)(mou)(mou)(mou)(mou)(mou)15萬元(yuan)的(de)(de)(de)債(zhai)(zhai)務(wu)(wu)。根據“兩高(gao)”《關于(yu)辦理貪污賄(hui)賂(lu)刑(xing)事案件適用法律(lv)若干(gan)問題的(de)(de)(de)解釋(shi)》,賄(hui)賂(lu)犯罪(zui)中的(de)(de)(de)“財(cai)(cai)物(wu)”,也(ye)包括債(zhai)(zhai)務(wu)(wu)免(mian)除(chu)等(deng)財(cai)(cai)產(chan)性利益。本案中,華某(mou)(mou)(mou)(mou)(mou)(mou)(mou)(mou)(mou)(mou)某(mou)(mou)(mou)(mou)(mou)(mou)(mou)(mou)(mou)(mou)實際獲得的(de)(de)(de)是15萬元(yuan)的(de)(de)(de)財(cai)(cai)產(chan)性利益。

  三、國家工作人(ren)員(yuan)利用職務之便使特定關系人(ren)獲(huo)得財產性利益應(ying)視為國家工作人(ren)員(yuan)本人(ren)收(shou)受財物

  實踐中,國家工(gong)(gong)作(zuo)人(ren)(ren)(ren)(ren)員(yuan)利(li)(li)用職務之(zhi)(zhi)便獲取的(de)財(cai)(cai)物(wu)并不(bu)一(yi)定(ding)都(dou)為其本(ben)(ben)(ben)人(ren)(ren)(ren)(ren)占有(you)使用,這(zhe)并不(bu)影(ying)響對(dui)其受賄罪(zui)的(de)認定(ding)。根(gen)據《意(yi)(yi)(yi)見》相(xiang)關規(gui)定(ding),“國家工(gong)(gong)作(zuo)人(ren)(ren)(ren)(ren)員(yuan)利(li)(li)用職務上的(de)便利(li)(li)為請(qing)(qing)托(tuo)人(ren)(ren)(ren)(ren)謀取利(li)(li)益,授(shou)意(yi)(yi)(yi)請(qing)(qing)托(tuo)人(ren)(ren)(ren)(ren)以本(ben)(ben)(ben)意(yi)(yi)(yi)見所列形(xing)式(shi),將有(you)關財(cai)(cai)物(wu)給予特(te)定(ding)關系(xi)(xi)人(ren)(ren)(ren)(ren)的(de),以受賄論(lun)處(chu)”。特(te)定(ding)關系(xi)(xi)人(ren)(ren)(ren)(ren)之(zhi)(zhi)所以能(neng)夠獲利(li)(li),完全是基(ji)于(yu)國家工(gong)(gong)作(zuo)人(ren)(ren)(ren)(ren)員(yuan)與(yu)請(qing)(qing)托(tuo)人(ren)(ren)(ren)(ren)之(zhi)(zhi)間的(de)權錢交(jiao)易(yi)(yi)和國家工(gong)(gong)作(zuo)人(ren)(ren)(ren)(ren)員(yuan)對(dui)交(jiao)易(yi)(yi)對(dui)象(xiang)的(de)處(chu)分,故(gu)特(te)定(ding)關系(xi)(xi)人(ren)(ren)(ren)(ren)收受財(cai)(cai)物(wu)應視為國家工(gong)(gong)作(zuo)人(ren)(ren)(ren)(ren)員(yuan)收受財(cai)(cai)物(wu)。本(ben)(ben)(ben)案中,華(hua)(hua)某(mou)某(mou)為華(hua)(hua)某(mou)的(de)特(te)定(ding)關系(xi)(xi)人(ren)(ren)(ren)(ren),華(hua)(hua)某(mou)主動要求須某(mou)以“工(gong)(gong)抵房(fang)”形(xing)式(shi)將相(xiang)關商品(pin)房(fang)低價(jia)出售給華(hua)(hua)某(mou)某(mou),事(shi)后對(dui)于(yu)須某(mou)免除華(hua)(hua)某(mou)某(mou)15萬元(yuan)(yuan)債(zhai)務的(de)情況也明(ming)知,因此應視為華(hua)(hua)某(mou)本(ben)(ben)(ben)人(ren)(ren)(ren)(ren)獲得15萬元(yuan)(yuan)財(cai)(cai)產性利(li)(li)益。

  四、華(hua)某(mou)和須某(mou)相(xiang)關行為的(de)本質(zhi)系權錢(qian)交易

  受賄罪的本質是權錢交易(yi),即國家工(gong)作(zuo)人員(yuan)以職務(wu)上的行(xing)為(wei)(wei)(wei)(wei)作(zuo)為(wei)(wei)(wei)(wei)權錢交易(yi)的對價(jia),換取請托人提供的財物。本案中,華(hua)(hua)(hua)(hua)某(mou)(mou)(mou)雖然(ran)沒有(you)直接參與(yu)簽訂房(fang)(fang)屋買(mai)賣合同,但是作(zuo)為(wei)(wei)(wei)(wei)國企工(gong)程管理部的副(fu)經理,其熟知“工(gong)抵房(fang)(fang)”的買(mai)賣流程及操作(zuo)方(fang)式。華(hua)(hua)(hua)(hua)某(mou)(mou)(mou)在華(hua)(hua)(hua)(hua)某(mou)(mou)(mou)某(mou)(mou)(mou)購買(mai)商(shang)品房(fang)(fang)前主動找到須(xu)(xu)(xu)某(mou)(mou)(mou),希(xi)望通過須(xu)(xu)(xu)某(mou)(mou)(mou)以“工(gong)抵房(fang)(fang)”形式低價(jia)獲(huo)得商(shang)品房(fang)(fang),而須(xu)(xu)(xu)某(mou)(mou)(mou)為(wei)(wei)(wei)(wei)感謝華(hua)(hua)(hua)(hua)某(mou)(mou)(mou)對其的幫(bang)助,明知華(hua)(hua)(hua)(hua)某(mou)(mou)(mou)的意(yi)圖(tu),仍然(ran)予以同意(yi),此時雙方(fang)主觀(guan)上已達成行(xing)受賄的合意(yi)。須(xu)(xu)(xu)某(mou)(mou)(mou)在簽訂了(le)(le)三(san)方(fang)協議后,未(wei)按(an)照合同價(jia)收取華(hua)(hua)(hua)(hua)某(mou)(mou)(mou)某(mou)(mou)(mou)的房(fang)(fang)款,而是選擇虧(kui)本交易(yi),免除了(le)(le)華(hua)(hua)(hua)(hua)某(mou)(mou)(mou)某(mou)(mou)(mou)的15萬(wan)元債務(wu),客(ke)觀(guan)上是通過債務(wu)免除的形式實(shi)現了(le)(le)對華(hua)(hua)(hua)(hua)某(mou)(mou)(mou)的利益(yi)輸(shu)送,該15萬(wan)元實(shi)質是華(hua)(hua)(hua)(hua)某(mou)(mou)(mou)權力的對價(jia)。雙方(fang)的行(xing)為(wei)(wei)(wei)(wei)表面上看屬于正(zheng)常(chang)的“工(gong)抵房(fang)(fang)”交易(yi),但實(shi)際上是以“工(gong)抵房(fang)(fang)”交易(yi)為(wei)(wei)(wei)(wei)幌子,掩(yan)飾其權錢交易(yi)的本質。
